There are two ways the State of Arizona classifies bribery.
1. Commercial Bribery. In the private realm, a commercial bribery is committed if a person confers a benefit to another person's employee with the intent to influence the conduct of the employee in relation to the employer's commercial affairs in which the conduct will cause economic loss to the employer. If this occurs and the benefit is accepted by the employee, the employee may also face charges for commercial bribery. The value of the benefit conferred will determine the penalties associated with Commercial bribery which can range from a Class 5 Felony to a Class 1 Misdemeanor.
2. Bribery of a Public Servant. Considered as a Class 4 Felony, bribery is defined by the Arizona Criminal Code as bribery of a public servant when a person confers a benefit upon a government employee with the intent to influence a vote or judgment. If the public servant solicits, accepts or agrees to accept the benefit, the public servant will also be charged with bribery.
