Arizona State law considers child abuse to be any person inflicting harm to a child under circumstances likely to cause death or serious physical injury, to cause them to suffer physical injury or to cause them to be placed in a dangerous situation. If the harm was inflicted intentionally and on a victim under the age of fifteen (15), the State of Arizona considers that offense to be a Class 2 Felony with a strong possibility of being classified as a Dangerous Crime Against Children (DCAC) which is subject to life imprisonment without the option of parole until after thirty-five (35) years are served. If this type of child abuse is committed by reckless conduct the offense is then considered to be a Class 3 Felony, and if committed by criminally negligent conduct, the offense is considered to be a Class 4 Felony.

If the circumstances of the abuse are not likely to cause death or other serious physical injury the offense is considered a less serious child abuse charge. However, if the abuse was intentionally inflicted, Arizona State law considers the offense to be a Class 4 Felony. If this type of child abuse is committed by reckless conduct, the offense is considered to be a Class 5 Felony, and if committed by criminally negligent conduct, the offense is then considered to be a Class 6 Felony.
