It is considered a felony to possess or use marijuana in the State of Arizona. The severity of the offense is determined based on the quantity of the drug. A charge of Class 6 Felony will be imposed upon any person charged with possession or use of marijuana, provided that less than two (2) pounds are found in possession with no indications for intent to sell the drugs. If baggies, scales, ledgers or other items evidencing sale are found in possession, the charged offense and associated penalties become more severe.
Drug crime cases that involve the sale of marijuana impose penalties directly related to the amount of drugs intended for sale or sold. A Class 6 Felony is imposed upon a crime involving less than two (2) pounds of marijuana intended for sale or sold. A Class 4 Felony is charged when there are two (2) to four (4) pounds of marijuana, and a Class 2 Felony when there are more than four (4) pounds of marijuana intended for sale or sold in Arizona.
Fines are enforced with drug crime convictions involving marijuana. The possibility of probation does exist with marijuana drug crimes only if the offense does not involve possession for sale, sale, or transportation of marijuana. In the event probation is sentenced, the terms of probation will include a minimum of an eight (8) hour class on the harmful effects of drugs and marijuana plus community service.
